MCSO Court Case Update regarding former Secretary of Clearwater Farms POA Unit 1

This hearing was particularly significant for me, as it was the first time I had seen her since Laurie and I retrieved the records from her residence. Fortunately, the proceedings went as expected. She entered a guilty plea to a Class 6 Felony and was sentenced to three years of probation, with White Collar Crimes conditions. This means she will be required to submit all financial and banking records for review.
The total theft amount was $44,000, which includes $5,000 as part of the original theft. She agreed to pay $39,000 in restitution at this time. An additional $15,000 in legal and accounting fees is under review by the judge, with no further trial required. She was ordered to make payments of $500 per month, though her attorney indicated she intends to pay the balance in a lump sum. The judge explained that the $500 payment structure was set to avoid setting her up for failure.

Overall, our collective efforts yielded a positive outcome for the community, and Kevin’s persistence with MCSO significantly expedited the case. The Court Liaison remarked that the evidence we provided was clear and well-organized. She will keep us updated, though changes will not be reflected on the public website for at least a couple of weeks.
I believe all of us involved in gathering the evidence are relieved to have reached this stage. Laurie and Britt can fill in any additional details I may have missed. Please reach out with any questions.

As a reminder, irrigation payments should no longer be handed directly to board members. With Raygina now receiving and recording irrigation checks, it’s important that all payments are mailed to the PO Box to ensure timely processing and proper record-keeping.

Notice: House Numbers to Be Painted in Back Alley Ditches
Dear Residents,
Please be advised that volunteers will be working in the back alleyways—specifically Ditches 2, 4, 6, and 8—to spray paint house numbers in the ditches. This effort is to help improve identification and visibility for maintenance and safety purposes.
You may notice volunteers working in or near the ditch areas over the coming days. We appreciate your understanding and support as we complete this project.

Desert Weed Spraying:
Desert Weed will be spraying Ditch 9 early Friday morning 6/13/25, as that will give the ditch a little more time to be dry. He will also drive the community to check for any other areas that need attention.
For those on Ditch 9, please try to go out and knock down any tall weeds and trim up trees so he can get through to spray. Also, in a week or so head out and pull the dead and dying weeds. Thanks!
Ditch Maintenance
To ensure safe and efficient ditch maintenance, please adhere to the following guidelines for Ditch 9 (and all other ditches):
✅ Clear Vegetation in the Ditch – Remove all weeds and debris to prevent obstructions.
✅ Trim Side Growth – Maintain clear pathways for volunteers walking along the ditch.
✅ Trim Trees to 8’ Height – Ensure easy passage for workers.
✅ Properly Dispose of Debris – Do not throw weeds or branches into the ditch—use designated dumpsters.
Why This Matters:
- Overgrown vegetation can hide snakes and other hazards, posing risks to volunteers working day and night.
- Weeds have already been sprayed, making this the ideal time to clear them out.
- Non-compliance will result in violations and fines.

Irrigation Information
Important: Please Review the Irrigation Information document under the Irrigation tab. If you plan to irrigate, it's crucial that you familiarize yourself with its contents. We have recently encountered several issues with irrigation water overflowing the ditches, leading to damage.
If you are unable to utilize all or part of the irrigation water you ordered, please coordinate with your neighbors to see if they can accept the excess. If that's not possible, reach out to a board member for assistance in diverting the extra water.
Please remember, that once irrigation water arrives at your property at the scheduled time, it is your responsibility until your scheduled time is complete. Releasing water early can lead to fines and/or charges for repairs to the irrigation system.
Additionally, if your checks are in the ditch, your ports must be open. Please ensure that your checks are removed if your ports are closed. To reiterate, checks should only remain in place when you are actively irrigating. Also remember if you are the last irrigator on a ditch, leave your check in and ports open.

Outstanding Balances:
As of November 1st, 2024, Members with outstanding balances at City Property for Annual Assessment dues will be restricted from irrigating until paid in full. Your access to irrigation services will be suspended until outstanding dues and liens are cleared. Visit cityproperty.com to make an online payment or to set up a payment plan.
If you are going to do work around the Irrigation ditches, service roads, main roads, or bar ditches that will alter those areas, please make sure you contact the board first before proceeding.
Please remember that if an irrigation run is canceled, it WILL NOT roll over to the next irrigation run. You MUST sign up on the irrigation board to receive the water you ordered for each run.
Please monitor your water for leaks due to extreme gopher activity and remember as a homeowner it is your responsibility to maintain your irrigation ditch and bar ditches. Please remove debris (tumbleweeds, weeds, trash) so that it doesn't impede water flow to you or your neighbors!!!

CUTOFF TIME FOR IRRIGATION SIGN UP IS 7:00PM BOTH ON LINE AND AT THE IRRIGATION BOARD, WE ARE UNABLE TO ACCOMMODATE IRRIGATION ORDERS AFTER THIS TIME.
Low Water Flow:
The Maricopa County water master has notified us that they have received 8 calls for low water flow from Members of Clearwater Farms Unit 1. Of those calls; 7 out of 8 were the correct flow. MWD has told us if they continue to receive these calls; they will stop coming out. Someone also complained that we were receiving too much water, so they are giving us exactly 90".
Board Members are working with MWD to have miner rulers installed near the main boxes so Members can check the flow themselves but in the meantime, if there is a water flow question or concern please call Resa Rodney at (602) 717-2912.
